Dear Ms. Truitt:
I spoke with your Southlake office manager yesterday concerning the fraudulent financial statements that my insurance company, MONY, has filed in Texas for the last 19 years and the subsequent fraud on the public that has resulted. She informed me that you were aware of the situation and that you had talked to numerous other Representatives and State Senators, including Senator Chris Harris. She informed me that it had been concluded that you and Mr. Harris had no authority to cause anyone to produce an accurate, concise and properly opined financial statement for the company and that there was nothing that you could do to help.
If this is the case, I request that you confirm it in writing. Perhaps a simple statement to the effect that.......... members of the Texas Senate and Texas House of Representatives were aware that the Texas Department of Insurance had gone along with an illegal plan to hide the insolvency of the Mutual Life Insurance Company of New York during the mid 80's and as part of the plan, the TDI had approved the sale of ill-conceived insurance products that illustrated dividends based on double digit returns on nonexistent assets. That the TDI was aware that the company was being looted by its officers and directors, that Jose Montemayor and John Watson were deeply involved from 1995 forward in a criminal conspiracy to cover-up and conceal the company's fraudulent financial statements and the involvement of elected officials in Texas who had personally profited from real estate transactions with the company after they found out about the fraudulent financial statements.
I would appreciate your also including the fact that you first became aware of this situation prior to your first term in office and that you have reviewed that information that I have sent to your office.
For your review, I am attaching copies of news articles from New York and Connecticut concerning MONY's fraudulent insurance policies. The very same contracts that were sold in Texas. New York and Connecticut policyholders got their money back plus interest while the rest of us got to pay the fines and further reductions in dividends. The failure of the Texas Department of Insurance to take any action has now resulted in millions of dollars in losses by the Texas Teachers Retirement System from the pump and dump of MONY's stock!

Dear Mr. Abshire:
Per your request, I am writing to you regarding efforts taken on your behalf by my office and the offices of the Attorney General, Texas Department of Insurance, and the Travis County District Attorney.
Research indicates that enormous consideration was given to your complaint with the Texas Department of Insurance. Your case was thoroughly investigated when it was originally opened in 1995. Subsequently, it was reviewed for over a year at the request of State Senator Chris Harris in 1997. None of these investigations substantiated your allegations against the Mutual Life Insurance Company of New York.
Even with the extensive time, money, and effort that has already been expounded on this issue, I have contacted the Texas Department of Insurance and the Office of the Attorney General again on your behalf According to these offices, no new evidence has been presented to them that would warrant revisiting this issue.
Although I am not an attorney, it is my understanding that persons who feel that fraud has been committed against them have the right to pursue legal remedies. You might want to contact an attorney to discuss your legal options.

Dear Ms. Truitt:
Your April 24, 2001, letter in response to my April 17, 2001, request makes reference to your research of the "enormous consideration" that was given to my 1995 complaint to the Texas Department of Insurance concerning the Mutual Life Insurance Company of New York and the thorough investigation that was undertaken by the TDI. Attached is a copy of an April 6, 1998, letter to Ms. Carol Frasier at the TDI regarding my Open Records request for the "complete investigative file of MONY"! The file contained the information that I sent and a couple of cya letters by Montemayor and John Watson. Watson even went so far as to lie about the witnesses that he stood-up twice! There was no investigation as you have been lead to believe....only a cover-up!
You also reference Senator Chris Harris and his request for a review after I wrote him on May 27, 1997, requesting "Can you help me obtain an accurate financial statement for my life insurance company?" (copy attached). Mr. Harris did not respond to my request and there is no mention of Senator Harris in the "complete investigative file of MONY" that I received. As a matter of fact, Senator Harris was the recipient of PAC contributions from MONY's lawyers and like State Representative Lon Burnam, who boasted that V&E had no choice but to give him $5,000 for access because he was on the Insurance Committee, he took no action. Mr. Burnam made his statement after his own attorney had advised him that V&E's attorney had committed a criminal act in the naming of a dead man as a witness in Wassell vs MONY and then billing the company for a conference call with the corpse.
You also mentioned the office of the Attorney General, which reminded me of the referral by Attorney General Dan Morales to the Fraud Unit concerning the above mentioned attorney and his fraudulent billings. I have attached a copy of a letter to Michael Feary for which he did not answer and took no action. You may recall that former Assistant US Attorney General Webster Hubbell went to prison for similar practices as did the Superintendent of the Dallas ISD for using falsified expense vouchers. I was also personally informed by Jose Montemayor that he had no problems with MONY's officers using falsified expense vouchers for gambling money as long as they were having a "Contest".
You have either been mislead by the TDI and Senator Harris or you have chosen a path that is not in the best interest of your constituents. The evidence of corruption and criminal wrongdoing is overwhelming! You cannot produce or cause to be produced or even name anyone who can cause or produce an accurate, concise and properly opined financial statement for MONY for over 15 years! MONY's policyholders in Texas are entitled to the same remuneration that was received by policyholders in New York and Connecticut.
I asked for a proper financial statement or the truth! Your response is unacceptable in it's current state. I ask that you rethink your current position as it will no doubt cause great embarrassment!
